Terms and Conditions For End Users of Bearicuda Products


Freight/Delivery

  • F.O.B. Litchfield, CT 06759, but not limited to. All freight charges are prepaid and add unless other arrangements are made. Orders will be shipped via UPS whenever possible. Bearicuda adds a nominal handling charge to UPS shipments. If consignee billing is desired, we require the UPS consignee number of the company that will receive our products. We require the number to release the order. When UPS limits are exceeded, we will strive to ship the least expensive, most direct way, taking into account good product condition, unless instructed otherwise.

  • Bearicuda, Inc maintains a very high standard when shipping your orders quickly. Many Bearicuda Products ship within 1-7 business days but not limited to. Other items may have up to a 3-4 week lead time, but not limited to. Any order that requires next day delivery or special expedited shipping attention needs to be placed no later than 11:00am EST with a special note on the actual order in the "Add Note Section". Please call us at 1-877-232-7428 if you have any concerns regarding your shipment. Bearicuda, Inc reserves the right to withold any order for processing for any reason.

  • You will be expected to accept the delivery. If our courier is unable to complete the delivery of a shipment, a notice will be left stating that a delivery has been attempted. The courier will attempt to deliver the shipment without additional charge. However, if the courier is unable to make delivery a service charge may be applied to your account.

    During delivery, we advise that you inspect the package prior to accepting it. If damage is noticeable, please mark the word "damaged" on shipping document "Delivery Receipt" before you sign it. You may choose to decline the shipment and arrangements will be made to rectify the situation. If damage is severe, Bearicuda will initiate a freight claim with the courier.

  • For Standard Motor Freight Deliveries. These are shipments that are delivered by semi-trailer truck or similar type vehicle and offloaded by the Purchaser. A complete description of how the freight is delivered and what will be required by the purchaser is listed below: Shipments will be delivered to or as close to the Purchasers property line and or driveway provided the location is deemed accessible by the delivering carrier. It is the Purchasers responsibility to inform Bearicuda at time of purchase of any unusual or difficult location or delivery issues so necessary arrangements may be made with the delivering carrier where possible. Purchasers may incur additional shipping costs depending on the Purchasers specific situation. The delivering freight carrier is not obligated to assist the Purchaser with unloading of freight. Purchaser will be expected to cut metal strapping securing product to the pallet, therefore the use of wire cutters is required. It is strongly recommended that the Purchaser have at least two assistants to help offload freight from the truck. Purchasers should be aware that although total freight could be over 3000 lbs, units will be offloaded one piece at a time with individual pieces and components ranging between 1-100 lbs that should be manageable in most situations but not all situation, sometime items come prebuilt with no pieces at all, just one item weighing the full weight. Purchaser will be given a reasonable time frame to unload freight from the delivering freight carrier vehicle, ranging between 10-30 minutes. Purchaser agrees to accept all financial responsibility for demurrage and rerouting costs if the ship-to location is changed after the product is shipped from our premises. Shipment method/procedure must be confirmed at time of order. Purchaser should be aware that all freight is prepaid and that no additional freight charges should be paid to delivering carrier unless Purchaser alters or changes any prior arrangements. Any deviations to prearranged shipping methods will result in additional costs being billed to the Purchaser. In most cases, the delivering carrier will bill the purchaser directly for any additional charges, however in certain situations where it may not be possible or realistic for the delivering carrier to do so, Bearicuda will re-invoice or bill your account for any additional freight charges which have been incurred. Purchaser must inspect freight prior to unloading and document any damage prior to signing the Shipping Document "BILL OF LADING or DELIVERY RECEIPT" provided by the delivering carrier. Please ensure that you mark "DAMAGED" on these documents before signing for the delivery. Failure to document any such damage may result in delays in resolving or not being able to resolve any possible freight damage claims and/or delays in rectifying any problems encountered regarding freight damage mitigation. We do not accept returns due to bowing, warping, etc., over the course of time.


Payment Terms

  • If granted payment terms - Net 30 days. All orders invoiced at prices prevailing at date of shipment.
    Damaged Good or Shortages (on Prepaid Shipments only)
  • Shortages - If an order arrives without all items shown on the packing list, a notation must be made on the delivery receipt and customer service advised immediately.
  • Noticeable Damage - Upon receipt, check products carefully. Note on delivery receipt any damage or abnormality. Delivery receipts signed complete, without any noted discrepancies, will be the responsibility of the consignee and not Bearicuda, Inc. Notify customer service regarding any problems within 1 day. Bearicuda is not responsible for product that has been reshipped from the original destination.
  • Concealed damage - Any hidden damage must be reported to customer service within 1 day of receipt of shipment. Do not return product until you have notified a customer service representative and have a Return Goods Authorization ("RGA") number.
  • Collect Shipments are the responsibility of the consignee.
  • Product pricing may change at anytime and Bearicuda, Inc reserves the right to increase prices even after a customer may place an order on our web site. A Bearicuda representative will call the customer in the event of a price increase and give the customer the option of accepting such an increase or cancel the order. (This does not apply to shipping charges-shipping charges will be added to the invoice)

Return Policy
  • RGA number must be obtained from customer service. RGA requests can be made up to 3 days from date of purchase.
  • Product must be in original packaging. No discontinued or obsolete items will be accepted.
  • Customer pays freight charges to get product to their place of business or residence and to return the product to our facility.
  • Bearicuda, Inc reserves the right to refuse any return not in compliance with the above.
  • Special orders, cut or manufactured to specifications, All enclosures which include but not limited to the Aspen, WilliamsBurg, Bostonian, Canterbury and Metal Enclosures are not returnable once ordered and are in production.
  • All products on packing slip must be inspected upon delivery and pick up at our offices. Take off packaging material, inspect carefully for any damage upon transit. All damage should be documented and product refused if you do not wish to keep the merchandise. The same day you receive the merchandise call Bearicuda, Inc at 1-877-232-7428 to report the damaged goods.
  • Returns must be made within 2 days of receipt of merchandise.
  • We do not accept return for any damages related to squirrels (all animals), customer damage, or any other animals that can chew through an item that is purchased such as a container, wooden enclosure, strap or plastic.
  • All Customer pick ups for any products at our facilities are the responsibility of the customer to inspect all products at the time of pick up. Once customer leaves our facility, the customer is responsible for any damage that may ocurr due to transporting and set up.
  • A 25% restocking fee applies to all orders and all products shipped and in production.
  • There are no returns on Cedar or Trash bins with the prefix ENC, BIN, SHD, LNT (No returns on any Bear Proof Metal Dumpsters)
  • All Wooden Enclosures Prefix BIN, ENC, SHD, LNT are NOT guaranteed to keep out animal that chew and are not considered a 100% animal proof, just animal resistant. These deter and in most cases keep out many types of animals but are not by any means a guarantee against penetration, especially animals that chew.
  • All Wood Enclosures have a 30 day warranty period from Manufacture defects, any defects must be reported within this time period. Bearicuda reserves the right to repair any product before any return is authorized. This includes but not limited to all wooden enclosures with prefixes BIN, ENC, SHD, LNT, All Animal / Bear storage lockers and dumpsters and all Trash Cans.


Shipping Policy

  • The total invoice amount does NOT include Freight charges on any our Bear Proof Cans. If you do NOT see freight appear this does not mean the freight is free, we just are unable to calculate it online. Many of our Bear Cans ship out using UPS or a "Common Carrier" Trucking Company, whichever is less expensive. Many of our cans are classified as "oversized" by UPS and can have additional charges by UPS, example 30, 32, 64, 68 and 95 gallon cans. We will add the correct amount to your credit card once we know the final shipping charge from the appropriate carrier. Charges may range from $49-$175 but not limited to depending on what part of the country you live and the size of your order. Two charge amounts can appear on your credit card, The first for the actual product charge you see on this invoice and the second for the freight(Again, you will not see the freight amount appear on this electronic receipt, a final invoice will be mailed with the correct shipping charges). Please, you must call us for the exact freight rate within 1 business day, otherwise the order will have been processed. If an item is refused upon delivery or if customer decides to return the product for any reason the customer is responsible for shipping charges to your door and back to ours.


Guarantee/Warranty

  • Bearicuda products are guaranteed against defects in workmanship for a period of 30 days.
  • Products excluded from warranty coverage, unless found and reported defective as per terms and upon removal from the original shipping container and before being used by the original purchaser and other items as noted on Addendum
  • Bearicuda will honor any sale price within 3 business days of customers prior order to that sale price of the exact item part number.
  • Bearicuda metal enclosures warranty is for manufacture defects in welding not for paint that chips or rusts over time. Powder Coatings resist cracking, peeling, and chipping. Powder coat is abrasion, corrosion and chemical resistant. This does not mean that it will not crack, peel, chip, scratch, or corrode. It just means that it is more resistant than some other finishes. There has been a misconception that powder coat is crack, chip, peel, abrasion, corrosion, and chemical proof. That is sadly not the case. Powder coating is stronger than paint but given the environment it is subjected to, it can only resist so much, most notably salt water environments around coastlines. Also keep in mind the environment that your product is subjected to (for example, a home by the salt water and heavy winds). In addition if the metal gets scratched or opens up from a chip. If left unprotected, that small exposed area will then rust and spread rather quickly. If the rust is left alone, it is like cancer and will erode away at your finish. It is imperative that any scratches or chips are protected. All you need to do is get a can of Satin finish paint and cover the exposed area (Rustoleum works best). This seals the exposed area to prevent further corrosion. Again, painting over the exposed area is not 100% foolproof. It really depends on your environment. If the product is constantly exposed to salt wind, you need to check it periodically to prevent any further damage. We would love to offer a finish that would stay pristine from day 1 but sadly that is not possible. Powder coating is durable and generally longer-lasting in part due to how it is applied. Unlike paint, powder coat is applied as a dry powder with a small electrostatic charge that holds the powder to the metal. It is then baked in an oven which caused the coating to "gel" (or melt) into a smooth, consistent, smooth coating. Since it is applied dry, you do not have to worry so much about drips and runs. This process creates quite a durable finish but it is not bomb-proof. The durability of the finish is resists failure in "normal" service use. For example, a lawn chair that is powder coated will most likely not chip. Unfortunately for our products, they are subjected to scraping over rough surfaces, impacted by constant use and (for those living in ice/snow areas), etc. In short, powder coating gives consumers one of the most economical, long lasting and most color durable quality finishes available. Powder coated surfaces are more resistant to chipping, scratching, fading and wearing than other finishes. Colors will stay bright and vibrant longer than paint but keep in mind that it is only resistant. The powder coating finish also requires a bit of maintenance. The maintenance will depend on geographic location and what your subject your product to. Just use good judgement. If you see a chip or scratch, paint it to prevent further issues. Also periodically clean your finish with a rag, soap, and water.
  • There are many aspects to consider when determining the longevity of powder coatings including the nature of the application and the surrounding environment. Salt, pollution and general deposits will effect the lifespan of the product and it is always suggested that you follow a maintenance program to assist the longevity of the coating. The effects of ultra violet light, pollution, dirt, grime and salt deposits can all accumulate on your powder coated surface over time. A very simple regular maintenance program should be implemented to ensure the removal of any residues and extend the effective life of your powder coatings. As a general rule, cleaning should take place every six months. However, in areas where pollutants are more prevalent, especially in coastal or industrial regions, a cleaning program should be carried out on a more frequent basis (i.e. every three months). To clean your powder coated surface: 1. Carefully remove any loose deposits with a wet sponge. 2. Use a soft brush (non abrasive) or cloth, and a mild household detergent solution to remove dust, salt and other deposits. 3. Rinse off with clean fresh water. Detergents that recommend the use of gloves when handling should be avoided as this is a good indication that the detergent is harsh and, therefore, unsuitable for cleaning your powder coating. Although some strong solvents are recommended for removing sealants or other building residues, these may be harmful to the extended life of the powder coated surface and should also be avoided as the damage may not be visible immediately and may take up to twelve months to appear. If paint splashes, sealants or other residue need to be removed, then either Methylated Spirits, Turpentine, or White Spirits may be used safely. A1 ?   • Though BEARicuda Bin? trash cans have been rigorously tested and approved by the LWWF and IGBC, we cannot make with a 100% guarantee that a bear or any other animal will never penetrate any of our cans, bins, sheds or enclosures. All animals are unpredicatable and many (such as bears and more so squirrels, rats, mice and raccoons can be tenacious and have very sharp teeth which could possibly chew holes through plastic). All our cans and enclosures have been an effective deterrent against many types of animals of which most do not penetrate our product although the product maybe damaged in certain instances because this is the byproduct of having an animal trying to penetrate your trash. Because this kind of damage can occur Bearicuda Bins, Inc will NOT refund or replace the can. Example, squirrels, rats, mice, raccoons because of the sharp teeth and after prolonged periods of time could potentially gnaw into the can where other larger animals would not access. This is not common, but must be noted because no poly can on the market today is completely impenetrable. In most cases you will find this can an effective deterrent for bears and many other types of varmints. Also we do not advise chaining your trash can to any secure mechanism b/c this can cause more damage to the can and will most likely cause the body to crack, as this will void any warranty. Note - None of our ENC, BIN, DMP, PAK, LOC, REC, SHD Prefix Part #'s are refunable, once we begin production these wooden and metal bins and enclosures are not returnable.
